PREAMBLE 

The purchase of products through the website of Les Boutiques Leclerc Chaussures Inc. at http:chaussuresleclerc.com (the "web Site") is governed by the terms and conditions appearing below. These terms and conditions constitute a contract of sale (the "contract") between Les Boutiques Leclerc Chaussures Inc. and you (hereinafter "you" or "Customer") as soon as you complete an order for a product (s) via the web Site and that you make the payment of the price of sale under the terms of section REF _Ref242077164 h 4 of the contract.

 

Les Boutiques Leclerc Chaussures Inc. may change the terms and conditions applicable to the sale of products through the web Site without any notice. However, the terms and conditions applicable to a purchase in particular remain those provided for in the contract, which are the terms and conditions applicable to the sale of products in effect on the web Site at the point where your order is carried out with Les Boutiques Leclerc Chaussures Inc. Section REF 10 pm _Ref242077285 contract.

 

Except provision inconsistent or otherwise provided in the contract, the provisions of the terms of use, the privacy policy, shipping policy and return policy ("other") you shall apply as if they were recited at length in the contract. You declare to have read and agree to be subject. However, the terms and conditions provided below take precedence over other provisions.

 

SALE 

The sale of a product that you would like to order through the web Site will take effect at the point where you have completed the order process (as explained below) and that you have completed payment of the selling price under the terms of section REF _Ref242077164 h 4 of the contract.

 

SALE PRICE 

The price of a product is indicated next to this product on the website at the point where your order is carried out with Les Boutiques Leclerc Chaussures Inc. Section REF 10 pm _Ref242077285 contract.

 

Les Boutiques Leclerc Chaussures Inc. may modify at any time and without notice the price of its products on its web Site. The price of the products offered on the website may vary from prices offered by independent merchants advertised on the web Site.

 

APPLICABLE TAXES 

Federal and provincial sales taxes are to be added to the price of sale.

 

TERMS OF PAYMENT 

The payment of a product is made by credit card (VISA or Master Card) via PayPal.

 

In order to proceed to the payment of a product and the applicable taxes, you will need to register in the area of a secure payment web Site a credit card number, the expiration date and your name and first name as the holder of the credit card or your payment PayPalMC information.

 

DELIVERY 

Les Boutiques Leclerc Chaussures Inc. will deliver the products ordered to the address you have provided in the order through the services of Canada Post or Purolator at our choice. Any indication as to the delivery time is approximate and the delay is not secured by Les Boutiques Leclerc Chaussures inc. Any default in the delivery may not result in the responsibility of Les Boutiques Leclerc Chaussures Inc. including any harm or damage, direct or indirect, that you may suffer.

 

No delivery will be made to a box or a post office box. 

 

TAKING OF POSSESSION AND ASSUMPTION OF RISK 

The products you buy on the website of Les Boutiques Leclerc Chaussures Inc. are delivered by Canada Post or Purolator, which are entirely independent of Les Boutiques Leclerc Chaussures Inc..

 

When you receive  the products you ordered, you become owner and assume the risk of delivery (loss or breakage during delivery).

 

Where your package is lost or damaged in the delivery and your products are also damaged, your only recourse is against the carrier. Our return policy is not valid if the original packaging of the product is not in good condition.

 

If you return a defective or damaged product to Les Boutiques Leclerc Chaussures Inc. and the original packaging is not in good condition and suggests that the defect or damage to the product was caused in its delivery, Les Boutiques Leclerc Chaussures Inc. reserves the right to return to you the product and to keep the selling price of the matter.

 

CLIENT STATEMENTS 

By completing an order, you swear to Les Boutiques Leclerc Chaussures Inc. that you have the legal age to contract. It is strictly prohibited for children under fourteen (14) years of age to proceed with the purchase of products through the website.

 

By completing an order, you swear to Les Boutiques Leclerc Chaussures Inc. that you make your purchase of products through the web Site only in a purpose of personal consumption and not for a purpose of resale, distribution or marketing of these products to third parties. In addition, you declare that the personal information sent to Les Boutiques Leclerc Chaussures Inc. for billing to complete the purchase is accurate. Les Boutiques Leclerc Chaussures Inc. is a corporation legally incorporated by virtue of Part 1A of the companies Act (Québec) having its registered office at 1495 rue des Tanneurs, Québec, Quebec, G1N 4S7.

 

DESCRIPTION AND AVAILABILITY OF THE PRODUCTS 

Descriptions and illustrations of the products offered or advertised on the website are provided only for information purposes. They can vary slightly between real products. Thus, you agree that such changes might occur and acknowledge that Les Boutiques Leclerc Chaussures Inc. cannot be held responsible for any damage or loss related to such changes. Les Boutiques Leclerc Chaussures Inc. offer no guarantee for these descriptions and illustrations. However, if these variations are not the characteristics of the product that you choose in your order (for example: the style, the color or the size) and differ from what you ordered and what you have received for these features, you can return the product ordered to Boutiques Leclerc Chaussures Inc. according to its return policy.

You can then choose i) to cancel the sale, in which case Les Boutiques Leclerc Chaussures Inc. will refund you in full the price paid or ii) to ask that Les Boutiques Leclerc Chaussures Inc. tries to get the said product from another of its suppliers. But in this case, you understand that Les Boutiques Leclerc Chaussures Inc. shall not be held responsible if it is unable to obtain it or get it within a reasonable time. Your sole remedy in this case is the cancelation of the sale.

 

HOW TO ORDER A PRODUCT 

To order a product, you will be prompted to indicate the desired characteristics of the product among the options (style, color, or size). You will then place the product in your virtual cart and proceed to a virtual checkout. You will then be asked to provide certain information in an information entry screen. To do so, you will have to follow the steps indicated on the screen of your computer. Then, you will be prompted to pay the sale price of the product and the applicable taxes.

 

To place your order on a final basis you must first accept the other conditions and press the icon "submit my order". PRESSING WITH YOUR CURSOR ON THIS ICON COMPLETES THE ORDERING PROCESS AND INDICATES THAT YOU AGREE TO PURCHASE THE PRODUCTS LISTED IN THIS COMMAND AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THE CONTRACT AND THOSE OTHER CONDITIONS.

 

GUARANTEE 

Les Boutiques Leclerc Chaussures Inc. offers no guarantee on products offered on its web Site. The only warranty applicable to the products is offered by the manufacturer of the product. For any matter relating to the guarantee of the manufacturer and the terms for the return of a defective product that would not qualify under Les Boutiques Leclerc Chaussures Inc.'s return policy, please contact the customer service of Les Boutiques Leclerc Chaussures Inc.

 

CANCELATION OF AN ORDER BEFORE DELIVERY 

Only if your ordered products were not already given for delivery, you can cancel your order free of charge by notifying the customer service of Les Boutiques Leclerc Chaussures Inc. in the manner described in section REF _Ref241893243 h 18 below.

 

RETURN OF A PRODUCT 

The return of a product is subject to Les Boutiques Leclerc Chaussures Inc.'s return policy.

 

THE CONTROL ACCURACY AND BILLING 

You are responsible to ensure the accuracy of the description of the product (style, color or size), the price of the product as well as all the details of billing and, where appropriate, to correct any errors or inaccuracy. If it is impossible to correct any errors or inaccuracies, you must promptly notify Les Boutiques Leclerc Chaussures Inc. in writing in the manner provided in section REF _Ref241893243 pm contract.

 

Once the order is completed permanently, you will receive by email, within fifteen (15) days, a confirmation of your order with the previously paid invoice and contract in digital format. You must print a copy of this email to make sure the information referred to in the purchase confirmation message is correct and recheck the terms and conditions of the contract which are applicable to you.

 

You have a period of thirty (30) days of the receipt of your invoice to correct by Les Boutiques Leclerc Chaussures Inc. as long as you can demonstrate that your invoice contains errors or inaccuracies. The expiry of this deadline, the information listed on your invoice shall be deemed to be accurate.

 

ACCEPTANCE OF THE CONDITIONS OF THE CONTRACT AND THE OTHER PROVISIONS 

By completing the ordering process, you are deemed to have accepted all the provisions of the contract and all other provisions.

 

LIMITATION OF LIABILITY 

Les Boutiques Leclerc Chaussures Inc. and its officers, directors, employee (e) s, agents, and their successors and assigns, cannot in any case be liable for any direct, special, indirect or collateral of any kind of damages, including any loss or damage of the nature or subject to a loss of business, loss of savings, loss of data or loss of profits products sold under contract or operations performed by the Client on the website, even if Les Boutiques Leclerc Chaussures Inc. knew or should have known the possibility of such damages.

 

In all cases where Les Boutiques Leclerc Chaussures Inc. or its officers, directors, employee (e) s, agents, or their successors or assigns, should be held accountable for any reason whatsoever, the amount that can be claimed cannot exceed the total amount paid

It may be that REF _Ref241895145 h 16.1 and 16.2 h _Ref241895146 REF paragraphs you are not applicable because of a law governing the rights of consumers or of another law of public order which may be applicable to your situation.

 

TERRITORIAL LIMITS 

Les Boutiques Leclerc Chaussures Inc. operates from its offices in the province of Quebec. Les Boutiques Leclerc Chaussures Inc. offers its products to people domiciled in Canada. No sales will be made to a person domiciled outside the territorial limits of Canada. Similarly, no delivery will be made outside the territorial limits of Canada.

 

VIEW 

Any notice, consent or other communication to the terms of this agreement must be given in writing and delivered by hand or by bailiff or sent by fax or email and sent in the following manner:

Notice, consent or other communication so sent shall be deemed to have been given and received on the day where it is delivered or transmitted (or, if this day is not a business day, the next business day) unless it is delivered or transmitted after 4: 30 pm (time of Quebec (Quebec)), in which case it shall be deemed to have been given and received on the following business day. For the interpretation of the contract, the term "business day" means any day of the year except Saturdays, Sundays and other days where financial institutions are generally closed in Quebec City, Quebec.

Les Boutiques Leclerc Chaussures Inc. may, on occasion, change its address by the update of the website.

 

GENERAL PROVISIONS 

The preamble is an integral part of the contract.

 

For the interpretation of the contract and to the extent where the context requires, the use of the masculine includes the feminine and vice versa and the singular includes the plural and vice versa.

 

Except as indicated as being to the contrary, a currency amount is in Canadian dollars.

 

The fact that Les Boutiques Leclerc Chaussures Inc. does not insist on the full execution of a commitment contained in the contract or does not always exercise a right that is given to it will not be considered as a waiver of that right or the execution of this commitment. Any waiver by Les Boutiques Leclerc Chaussures Inc. constitutes one of its rights under the terms of this contract  and will not apply unless it is established by a signed writing and this waiver will apply only to the law and the circumstances expressly covered by the waiver.

 

Each provision of this contract forms a whole separate so that any decision to the effect that one of its provisions is void or unenforceable will not affect the validity of the other provisions or their enforceability.

 

The contract is the full commitment of the parties hereto and nothing can be changed or amended without their written consent.

 

The contract is binding on the parties hereto and their heirs, successors, legal representatives and assigns and is for their benefit.

 

Contract is governed by and construed according to the laws in force in the province of Quebec.

 

The parties irrevocably submit disputes arising from this contract to the Federal and provincial courts located in the judicial district of Quebec.
